Procedure To Obtain Vietnam Five-Year Exemption Certificate For Overseas Vietnamese And Spouse, Children

This article aims to provide the readers full information of Vietnam 5-year visa exemption such as: Eligible cases for applying, required documents to process, procedure to apply and processing time of a 5-year exemption certificate.

1/ Persons who are eligible for Vietnam 5-year visa exemption:

– Vietnamese people residing abroad (overseas Vietnamese);

– Foreigner who is the spouse, child of a Vietnamese or overseas Vietnamese

– Return to Vietnam for the purpose of visiting relatives or dealing with private affairs (if going for other purposes such as commerce, study, seminar, investment, working …, you must apply for a short-term visa appropriate to the section destination of entry);

– Not subject to “not yet entered Vietnam” as prescribed in Article 28 of the Law on Entry, exit and residence of foreigners in Vietnam, specifically:

+ Being a suspect, the defendant, the person with related obligations in the criminal case or being the defendant, or the person with related obligations in a civil case, commercial business, labor, administration, marriage and family;

+ Being obliged to serve judgments, decisions of the Court, decisions of the Competition Handling Council;

+ Tax obligations have not been finalized;

+ Being obliged to abide by decisions on sanctioning administrative violations;

+ For reasons of national defense and security.

2/ Dossiers of application for Vietnam 5-year visa exemption

For first-time applicant, documents to be submitted include:

2.1/ 01 Visa application form, made according to form NA9

2.2. Original passport with at least 01-year validity if applying for a stamped visa exemption Certificate. In case, you do not wish to send your original passport, you can send a copy of the your passport’s front page to get a detached visa exemption certificate (in the form, you must choose “a detached certificate”).

2.3. 02 newly taken photos of 4 × 6 cm, white background, straight face, bare head, without wearing colored glasses (01 photo stuck to the declaration, 01 photo left or attached to the declaration);

2.4. Documents proving eligibility for visa exemption:

– For a foreigner of Vietnamese origin: Submit a copy of the following documents: Vietnamese birth certificate, decision to relinquish Vietnamese nationality, certificate of loss of Vietnamese nationality, Vietnamese passport, Vietnamese identity card , Vietnamese Household Register, and other papers issued by Vietnam.

– For other applicants, please enclose with the copy of: (1) Marriage Certificate and Vietnamese documents of his / gaping spouse; or (2) Foreign Birth Certificate and Vietnamese documents of his / her parent.

3/ Procedures and Processing time to obtain Vietnam 5-year visa exemption

If the applicants are outside Vietnam, they can come to Vietnam embassy or consulate to submit the documents. If the applicants are in Vietnam, they can come to Vietnam immigration office to submit. Besides, they also can submit through the third party (visa agencies).

– Within 01 working day (24 hours), from the date of receiving a complete and valid dossier, the embassy (or consulate or agency) sends a list of applicants for visa exemption documents to the Immigration Department (Ministry of Public Security) at Vietnam.

– Vietnam immigration department check and decide to issue or refuse visa exemption for the applicants within 7 working days

Note: The time for Immigration Department to verify records depends on the case.

– After processing time, the applicants will receive the result. If it is approved, a visa exemption sticker will be stuck onto passport, which is valid for 5 years and can stay in Vietnam maximum 180 days for each visit.
